These Terms and Conditions (“Terms”) govern your use of our website located at www.haxathleticclub.com (“Website”) and any services offered by HAX Athletic Inc. (“HAX,” “we,” “us,” or “our”). By accessing or using our Website and services, you agree to be bound by these Terms. Please read them carefully before using the Website.
1. Membership and Account
1.1. To access certain features or services, you may need to create an account. You must be at least 18 years old to register.
1.2. You are responsible for maintaining the confidentiality of your account credentials and all activity that occurs under your account.
1.3. HAX reserves the right to suspend or terminate your account if we suspect unauthorized access, misuse, or a violation of these Terms.
2. Website Content
2.1. All content provided on our Website is for general informational and educational purposes. HAX does not provide medical or professional healthcare advice.
2.2. All content, including text, images, videos, logos, and trademarks, is the property of HAX Athletic Club and protected by applicable laws.
3. User Conduct
3.1. You agree not to use the Website for any unlawful, harmful, or unethical purposes.
3.2. You must not engage in activities that disrupt the Website’s functionality or compromise its security.
3.3. You must not transmit viruses, malware, or any other malicious code through the Website.
4. Payment and Billing
4.1. Certain products and services require payment. By making a purchase, you agree to pay all listed fees and applicable taxes.
4.2. All payments are processed securely through trusted payment gateways. HAX does not store payment information.
4.3. By signing up for a recurring coaching membership, you agree to our cancellation terms. Cancellations must be made before your next billing date to avoid future charges. Your membership remains active until the end of the current billing cycle.
4.4. By signing up, you acknowledge and accept that there is a 30-day cancellation period. If you choose to cancel your subscription, one final charge will be processed before your membership terminates.
4.5. By signing up, you acknowledge and accept that there is a minimum two-month commitment for all coaching subscriptions.
5. Refund and Return Policy
5.1. Merchandise
Items may be returned or exchanged within 30 days if unworn, unwashed, and in original condition with tags attached.
Final sale and hygiene-sensitive items (e.g., socks, bottles) are non-returnable.
Customers are responsible for return shipping costs unless the item was defective or incorrect.
Refunds are processed within 5–7 business days once the returned item is received and approved.

5.2. Coaching Services
Coaching plans are non-refundable once services or programming have been delivered.
Monthly coaching subscriptions can be canceled at any time but are not refundable for the current billing period once a plan is issued.
Prepaid coaching plans (Several month pre paid payments) are non-refundable once coaching begins, though unused months may be credited toward future services at HAX’s discretion.

5.3. Workout Plans and Digital Products
All digital products (PDF plans, training packs, guides, etc.) are final sale and non-refundable once delivered.

6. Intellectual Property
6.1. All Website content and materials are owned by HAX and protected by copyright, trademark, and other intellectual property laws.

10. Indemnification
10.1. You agree to indemnify and hold harmless HAX Athletic Club, its coaches, affiliates, and contractors from any claims, damages, or liabilities resulting from your use of our services or violation of these Terms.
11. Liability Disclaimer for Training and Services
11.1. By participating in any HAX programs, training, or services, you acknowledge and accept the inherent risks of physical exercise and athletic training.
11.2. You agree that HAX, its coaches, contractors, and affiliates are not liable for injuries, health issues, or damages resulting from participation, whether supervised or unsupervised.
11.3. You are solely responsible for ensuring that you are medically and physically fit before participating.
12. Referral Program
12.1. Active HAX athletes are eligible to participate in our referral program.
12.2. You will receive a $50 USD coaching credit for each new athlete you refer who signs up and remains a paying client for at least two full months.
12.3. After 10 successful referrals, you will receive one free month of coaching.
12.4. Referral rewards are only valid while you are an active HAX athlete.
12.5. HAX reserves the right to modify or discontinue the referral program at any time without notice.
13. Modifications to Terms
13.1. HAX reserves the right to update or revise these Terms at any time without notice. Continued use of the Website after changes indicates acceptance of the updated Terms.
14. Termination
14.1. HAX may suspend or terminate your access to the Website or services at any time, with or without cause.
15. Governing Law
15.1. These Terms and any disputes arising from your use of the Website, services, or products shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict-of-law principles.
15.2. Any legal action or proceeding shall be brought exclusively in the courts located in British Columbia, Canada, and you consent to the jurisdiction of such courts.
